Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Roamly website and services (the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy.
Trust-first platform
Roamly is built around traveler trust. We do not sell paid boosts in traveler rankings. Business features are separated from recommendations. Learn more on our Neutrality & Trust page.
1. Acceptance of Terms
If you do not agree to these Terms, do not use the Service.
2. Changes to Terms
We may modify these Terms at any time. If changes are material, we will post a notice or email you. Continued use after the effective date constitutes acceptance.
3. Use of the Service
Roamly grants you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.
4. Accounts & Security
You must provide accurate information and keep credentials confidential. You are responsible for activity under your account.
5. User Content & License
You retain ownership of content you post (e.g., reviews, photos, comments, itineraries). You grant Roamly a worldwide, royalty-free, sublicensable license to host, store, display, distribute, adapt for formatting, and promote your content in connection with the Service. You represent you have the necessary rights and your content does not infringe others’ rights.
We may moderate, remove, or refuse content that violates these Terms or our policies.
5.1 Review Integrity (No fake or incentivized reviews)
Roamly is not a platform for fake, paid, or incentivized reviews. You agree not to post content that is deceptive, undisclosed promotional material, or written in exchange for compensation or benefits (cash, discounts, free items, or “review for perks”) unless Roamly explicitly introduces a disclosed program that permits it. We may remove suspected inauthentic content and restrict accounts that violate this rule.
6. Business Profiles, Claiming & Verification
- Public listings: Roamly may display business/place pages using public or community-contributed information.
- Claiming: Claiming a profile allows an authorized representative to manage certain fields (e.g., photos, details, responses to reviews, analytics, verification badge where available).
- Authority: By claiming or managing a business profile, you represent that you are authorized to act on behalf of that business.
- Verification: We may require verification steps (e.g., email/domain proof, documentation, or other signals). We may approve, deny, or revoke verification at our discretion to protect platform trust.
- No pay-to-rank: Claiming, subscribing, or paying Roamly does not change traveler rankings, Top Picks, or review visibility.
- Disputes: If multiple parties claim the same business, we may request additional proof and may suspend management access until resolved.
- Removal requests: We do not guarantee removal of legitimate public listings or reviews. We may correct factual inaccuracies, remove content that violates policy, and honor legal takedown obligations where applicable.
7. Trailblazers Marketplace
- Creators & split: Verified creators (“Trailblazers”) may sell itineraries, guides, or “city packs.” Creators keep 80% of the net sale price; Roamly retains 20% to cover platform costs.
- License to buyers: Purchases grant a personal, non-transferable, non-commercial license for your household’s use. No resale, redistribution, public posting, or commercial use.
- All sales final: Digital marketplace purchases are non-refundable, except where required by law or if Roamly withdraws access due to a verified rights issue.
- Roamly’s role: Roamly provides the platform and payment processing. We are not a party to creator-buyer contracts and do not guarantee creator content.
- Enforcement: We may remove marketplace items for policy violations, IP complaints, or safety concerns.
8. Plans, Billing & Cancellations
- Traveler plans: Roamly may offer free and paid plans for travelers (e.g., expanded AI guide generation, exports, or other premium tools).
- Business plans: Roamly may offer paid plans for businesses (e.g., profile management tools, analytics, verification features, and other business-facing functionality).
- Auto-renewal: Paid subscriptions auto-renew until canceled. You can cancel anytime; access continues until the end of the current billing period.
- No partial refunds: We don’t prorate or refund unused time in a billing period, except where required by law.
- Payments: We process via third-party providers (e.g., Stripe) and accept major cards. You authorize recurring charges unless canceled.
9. Neutrality, Sponsorships & Conflicts of Interest
Roamly is designed to minimize conflicts of interest. We do not sell paid boosts that change traveler rankings or Top Picks. Business participation, claiming, or subscriptions do not affect recommendation order. We may publish transparency commitments and enforcement notes on our Neutrality & Trust page.
10. Acceptable Use
- No unlawful, defamatory, deceptive, or infringing content.
- No impersonation, spam, scraping, or reverse engineering.
- No attempts to bypass security or interfere with the Service.
11. Intellectual Property
The Service (including branding, software, and design) is owned by Roamly and its licensors and protected by intellectual property laws. Except for the licenses expressly granted here, no rights are transferred to you.
12. Third-Party Services
Roamly integrates with third-party services (e.g., maps, analytics, payment processors). We are not responsible for their content, policies, or availability.
13. Suspension & Termination
We may suspend or terminate access for violations of these Terms or to protect users, the Service, or third parties.
14. Disclaimers
The Service is provided “as-is” without warranties. Travel involves inherent risks; check local conditions, regulations, and safety guidance. Roamly does not warrant accuracy, availability, or suitability of any recommendation or third-party venue.
15. Limitation of Liability
To the fullest extent permitted by law, Roamly and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill.
16. Indemnification
You agree to indemnify and hold harmless Roamly and its affiliates from claims arising out of your content, your use of the Service, or your breach of these Terms.
17. Governing Law & Venue
These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles. Disputes will be resolved in the courts located in [Your Venue]. (*Update these placeholders once you choose a jurisdiction.*)
18. Miscellaneous
- If any provision is unenforceable, the remainder stays in effect.
- These Terms, plus our Privacy Policy, are the entire agreement.
- Our failure to enforce a provision is not a waiver.
